5 February 20267 min readInsights

Understanding your rights as an employee is essential for a fair and productive working relationship. The Employment Act, 2007 provides comprehensive protections for workers in Kenya.

Key Rights

1. Fair Remuneration

Every employee is entitled to fair wages for work done. The government sets minimum wage rates that employers must comply with.

2. Leave Entitlements

  • *Annual Leave — Minimum 21 working days per year
  • Sick Leave — Minimum 7 days with full pay, then 7 days half pay
  • Maternity Leave — 3 months with full pay
  • Paternity Leave — 2 weeks with full pay
  • 3. Working Hours

The standard working week should not exceed 52 hours. Overtime must be compensated at 1.5x the normal rate.

    4. Protection Against Unfair Dismissal

An employer must have a valid reason and follow due process before terminating employment. Unfair dismissal entitles the employee to compensation.

    5. Safe Working Conditions

Employers must provide a safe working environment as prescribed by the Occupational Safety and Health Act.
